Terms of Service
1. Acceptance of Terms
By accessing or using the MasterCast platform (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, do not access or use the Service. These Terms apply to all users of the Service, including actors, directors, company administrators, pro-team members, and any other individuals who register an account.
2. Description of Service
MasterCast is a cloud-based platform that facilitates audition management, casting workflows, production coordination, and communication between theatre and film companies and performers. Features include, but are not limited to, audition session scheduling, actor profile management, callback tracking, cast offers, production hubs, and file sharing. MasterCast reserves the right to modify, suspend, or discontinue any aspect of the Service at any time without notice.
3. Accounts and Registration
You must create an account to use most features of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration and to update that information to keep it accurate. MasterCast may suspend or terminate your account if any information you provide is found to be inaccurate, false, or incomplete, or if you violate these Terms.
MasterCast is a casting and production platform used by performers of all ages, including minors who audition for theatrical and film productions. Users of any age may create an account. MasterCast does not technically enforce age verification or parental consent at the point of registration. However, where a minor (a person under the age of 18, or the applicable age of majority in their jurisdiction) uses the Service, it is strongly recommended that a parent or legal guardian be involved in and aware of that use. Parents and guardians are encouraged to review these Terms and supervise their child’s activity on the platform. MasterCast bears no responsibility for unsupervised use of the Service by a minor.
4. Subscriptions and Billing
Certain features of the Service require a paid subscription. Subscription fees are charged in advance on a monthly recurring basis. You authorize MasterCast to charge your payment method on file at the start of each billing period. All fees are non-refundable except where required by applicable law or as expressly stated in these Terms.
MasterCast uses Stripe as its third-party payment processor. By providing payment information, you agree to Stripe's Terms of Service and Privacy Policy. MasterCast does not store full payment card numbers on its servers.
MasterCast reserves the right to change subscription pricing at any time. You will be given reasonable advance notice of any price changes. Your continued use of the Service after a price change takes effect constitutes your acceptance of the new pricing.
5. Acceptable Use
You agree not to use the Service to:
- Post or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, or otherwise objectionable;
- Upload, share, or distribute any sexually explicit material, nudity, graphic violence, or content that exploits, sexualises, or endangers minors in any way;
- Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity;
- Upload or transmit unsolicited commercial communications (“spam”);
- Interfere with or disrupt the integrity or performance of the Service or its related systems;
- Attempt to gain unauthorized access to any portion of the Service or its related systems;
- Use automated scripts, bots, scrapers, or other tools to access the Service without prior written consent from MasterCast;
- Violate any applicable local, national, or international law or regulation;
- Collect or harvest any personal data from the Service without consent.
Explicit content is strictly prohibited on MasterCast. Any content that violates this policy will be removed immediately without notice. MasterCast reserves the right to suspend or permanently terminate the accounts of users who violate this policy. Where content constitutes or reasonably appears to constitute a criminal offence — including but not limited to the production, distribution, or possession of child sexual abuse material (CSAM) — MasterCast will report the matter and any available identifying information to the appropriate law enforcement authorities and/or relevant national reporting bodies (such as the National Center for Missing & Exploited Children in the United States, or equivalent organisations in other jurisdictions).
6. User Content
You retain ownership of any content you submit to the Service (“User Content”), including profile information, media uploads, and posts. By submitting User Content, you grant MasterCast a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, and display that content solely as necessary to operate and provide the Service.
You are solely responsible for the accuracy, legality, and appropriateness of all User Content you submit. MasterCast does not pre-screen User Content but reserves the right to remove or disable access to any User Content at its sole discretion, with or without notice, for any reason including violation of these Terms.
Do not upload content to which you do not hold the necessary rights. Uploading copyrighted material without permission may violate applicable copyright law and these Terms.
7. Intellectual Property
The MasterCast name, logo, platform design, software, algorithms, text, graphics, and all related intellectual property are owned by or licensed to MasterCast and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, create derivative works of, publicly display, or exploit any part of the Service without the prior written consent of MasterCast.
8. Third-Party Links and Services
The Service may contain links to third-party websites or integrate with third-party services (such as Stripe for payments or Azure for authentication). These links and integrations are provided for convenience only. MasterCast has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party services. Your use of third-party services is governed by their respective terms and privacy policies.
9. Termination
MasterCast may terminate or suspend your access to the Service at any time, with or without cause and with or without notice, including for violation of these Terms. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitations of liability, and dispute resolution) shall survive termination.
You may terminate your account at any time through the account settings or by contacting MasterCast support. Termination does not entitle you to any refund of pre-paid subscription fees except where required by law.
10. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which MasterCast is incorporated, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or the Service shall be submitted to the exclusive jurisdiction of the courts in that jurisdiction, unless otherwise required by applicable mandatory consumer protection laws in your country of residence.
11. Modifications to Terms
MasterCast reserves the right to modify these Terms at any time. We will notify users of material changes via the Service or by email. Your continued use of the Service after any modification constitutes acceptance of the updated Terms. It is your responsibility to review these Terms periodically.
Privacy Policy
1. Information We Collect
We collect information in the following ways:
- Account information: Name, email address, and authentication credentials provided during registration.
- Profile information: Actor profiles may include photos, headshots, videos, audio clips, résumés, measurements, skills, and other content you choose to provide.
- Usage data: Log data, IP addresses, browser type, device identifiers, pages visited, and actions taken within the Service.
- Payment information: Billing details processed by our payment provider (Stripe). MasterCast does not store full card numbers.
- Communications: Messages, support requests, and other communications you send to MasterCast.
2. How We Use Your Information
We use collected information to:
- Provide, operate, and improve the Service;
- Process payments and manage subscriptions;
- Send transactional and service-related emails (e.g., audition confirmations, cast offers, booking notifications);
- Respond to your support requests;
- Enforce these Terms and our Acceptable Use policy;
- Comply with legal obligations.
We do not sell your personal data to third parties. We do not use your personal data for advertising or marketing beyond the operation of the MasterCast Service itself.
3. Data Sharing
We may share your information with:
- Service providers: Third-party vendors who assist in operating the Service (e.g., Microsoft Azure for hosting and authentication, Stripe for payments, SendGrid or similar for email delivery). These providers are bound by confidentiality obligations.
- Company administrators: If you are a company member or assigned to a show, certain profile and availability information may be visible to the company's administrators within the platform.
- Legal requirements: We may disclose information if required to do so by law or in response to valid legal process.
4. Data Retention
We retain your personal data for as long as your account is active or as needed to provide the Service. If you close your account, we will delete or anonymize your personal data within a reasonable period, subject to our obligations to retain data for legal, tax, or compliance purposes.
5. Security
MasterCast implements reasonable technical and organizational measures to protect your data against unauthorized access, disclosure, alteration, and destruction. However, no method of transmission over the internet or electronic storage is completely secure. We cannot guarantee absolute security.
6. Your Rights
Depending on your jurisdiction, you may have rights with respect to your personal data, including the right to access, correct, delete, or restrict its processing. To exercise these rights, contact us using the details in the Contact section below. We will respond to verifiable requests within the timeframe required by applicable law.
7. Minor Users and Privacy
MasterCast serves the performing arts community, including minors who audition and participate in productions. Accounts may be created by or for users of any age. MasterCast does not implement age verification and does not technically enforce parental consent at registration. Parents or guardians of minors using the Service are encouraged to be aware of and involved in their child’s use of the platform.
MasterCast collects only the personal data necessary to provide the Service. Parents or guardians may contact us at any time to request access to, correction of, or deletion of their child’s personal data. We will respond to such requests within the timeframe required by applicable law.
Any content involving the exploitation or sexualisation of minors is absolutely prohibited and will be reported to law enforcement immediately. See Section 5 (Acceptable Use) for the full policy on prohibited content.
Disclaimer of Warranties and Limitation of Liability

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
MASTERCAST MAKES NO WARRANTY THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS, OR THAT ANY ERRORS IN THE SERVICE WILL BE CORRECTED. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM MASTERCAST OR THROUGH THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MASTERCAST, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, SERVICE INTERRUPTION, COMPUTER DAMAGE, OR SYSTEM FAILURE, EVEN IF MASTERCAST HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MASTERCAST’S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO MASTERCAST IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS (USD $100).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages, so some of the above limitations may not apply to you. In such jurisdictions, MasterCast’s liability is limited to the greatest extent permitted by law.
Indemnification
You agree to indemnify, defend, and hold harmless MasterCast and its owners, officers, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Service, including but not limited to any User Content you submit, your use of any feature of the Service, or your violation of any third-party rights.
Casting Outcomes
MasterCast is a platform tool only. MasterCast is not responsible for, and makes no guarantees regarding, casting decisions made by companies or directors using the Service. Casting outcomes are entirely at the discretion of the company or individual making the casting decision. MasterCast does not participate in, influence, or endorse any casting decision.
Cookie Policy
MasterCast uses cookies and similar technologies to operate the Service. Cookies are small data files placed on your device that help us provide a functional experience.
- Essential cookies: Required for authentication, session management, and core functionality of the Service. These cannot be disabled without breaking the Service.
- Performance cookies: Used to collect anonymized information about how users interact with the Service, helping us identify and fix issues. No personal data is shared with third parties for this purpose.
- Preference cookies: Store your settings and preferences (such as active company context) to improve your experience.
MasterCast does not use advertising or tracking cookies. By using the Service, you consent to the use of cookies as described in this policy. You can control cookie behavior through your browser settings, but disabling essential cookies will impair the functionality of the Service.
